FPL truck obstructed vision;
Suv East bound on A1A East Ocean bike rider
North bound on South SPT Rd. Most all have seen the recumbent bike rider. Will
post his name & condition Monday. Wondering why accidents are secret in the
"Point"?

*web writer note: web writer was called at home by a resident stuck
in traffic at A1A & SPT RD. He witnessed a MediVac Helio & asked if I knew what
was going on. Web writer replied no but would check it out later.
*Writer went to Police station garage and ask what happened and he
refused to say. Said he was not allowed to. Writer said WHAT!!! He said it’s
policy or words to that affect. I handed him a
www.sewallspointer.org, card and stated “that sounds like a Sunshine law
violation to me”. He then called LT. T and advised her who was asking, she
replied no report available for 60 to 90 days. I heard it on speaker phone.
Writer said Ok & began an info chase & consequently came up with 911 report as
above. Not from SPT PD.

Feb. 17, 2009: "GATOR REPORT":STUART
POLICE ARE CHECKING TO SEE IF AN AK-47 STYLE RIFLE SEWALLS POINT POLICE FOUND IN
A CAR THEY STOPPED SUNDAY IS THE SAME ONE PEOPLE WERE FIRING FROM A CAR IN EAST
STUART EARLIER. STUART POLICE HEARD GUNSHOTS
EARLY SUNDAY MORNING IN THE TARPON AVENUE AREA AND WERE TOLD SOMEBODY WAS
SHOOTING OUT THE WINDOWS OF A RED FOUR-DOOR SEDAN DRIVING DOWN THE STREET.
SEWALLS POINT POLICE MADE AN ARREST IN THE CASE.

Public Records request: From the Chief:
"There was a capsized boat in the
St. Lucie River out from
the dock at 17 WHP at around 11:25pm Monday night. The incident was handled
by MCSO Marine
Unit. The SPPD officers performed an “AOA” (Assist Other Agency), and therefore
did not prepare a written report. The incident is noted on both officer’s
activity sheets for that shift, and you may certainly have copies of those. You
may stop by the office anytime between 8am-5pm to pick it up. As always, if
there are any issues or questions, call me at 781-3378.

Speed traps: Our banner stated we would tell you why we think
Sewall's Point is a speed trap.
several years back when Commissioner Morris was "Police
Commissioner" aka "Public Safety" he responded to either a
newspaper article or something the writer wrote (don't recall
4 sure) about SPT being a speed trap. It was the paper and
Triple AAA naming SPT a "speed trap". Commissioner Morris
responded in a Town Meeting the the report or allegation was
"patently un-true". The writer remembers that specifically as
it caused the writer to recall the meaning of "patently":
" obviuosly, clearly, plainly".
Were you living in the Point or driving east Ocean Blvd.
toward the beach you knew what a speed trap was, it was sitting under the
Lonesome Pine just over the hump of the little bridge. It was a SPT police car
dressed in black sitting in the shade of the very large Australian Pine on the
beach. Of course it didn't matter if you were past the "dangerrous intersetion"
of SPT Rd. & Ocean (A1A) and on your way out of town and I think at that point
you were out of the Point! But that is the major spot whereby AAA came up
w/"speed trap" in the Point.
As the former Chief of the Point, Savinni not McCarty stated on
the link below, the police were concerned about accidents and wanted to prevent
them, especially at A1a & SPT Rd. Wow how is that? A police car is sitting
almost in total disguise, East of that intersection? Seems a "Speed Trap"
designation would slow cars down?
We have now police cars still primarily dressed in black, sitting with ALL
LIGHTS OUT parked in Premiere's driveway or immediately adjoining it on the
roadway. or sitting sameway, behind the bank/offices on A1A. That's not
prevention that's a "speed trap"!
The best prevention would be sitting at the
intersection with the roof lights flashing! At the very least at
least parking lights on. That kind of prevention can
be seen at "DOWNTOWN" shopping district just off PGA. Police cars/security is
set up every night with light bar flashing till the stores close
and shoppers have made it back to their cars.
Sitting black in a black police car is a speed trap. that is a patently true
statement. At the very least turn on the parking lights that might slow down
someone who doesn't know SPT is a speed trap! next time buy WHITE cars, how
about WHITE HYBRID ESCAPES? THE POINT DOENST NEED GAS GUZZING TURNPIKE CRUISERS.
At the next to last Town Meeting Comm. Morris asked the Chief to tell the Comm.
about the new radar detectors. The Chief honestly told Morris he new little
about them technologically(paraphrase). Comm. Morris commented he didn't have
one so he wanted to know more.
The writer wears one and loves it and has been wearing them for
years. He is an expert and will explain later w/pics. Also tell you which laser
jammers actually work, some do. The writer cruises the Point with his radar
detector on as well as his cars (very fast, Red Mustang GT, 300hp. stock) speed
control. I set it at 35mph on S. SPT RD. lest I doze off and hit 45.
One day 2 months back the writer was cruising South in his RED Mustang at
35mph on cruise when he spotted at rapidly approaching white dot in the
rearview. Before the next peek in the rearview the White dot blew by at about
55mph. Really pissed the writer/driver off as the next bend is blind, and the
home of friends pets & kids, Mandalay rd. Anyway i rode the neighborhood and
found the white dot, took it's pic sent it to the police and called them and
told them I would sign a complaint and to give the driver a ticket. I was told I
couldn't do that they said they would take care of it. Seems they drove to
residence and warned the driver. P.s. white German coupe initials MB. Will post

Sat. 29 Sept, approx 1:40P.M. Officer Downham writing a ticket.

" The
Officer stopped a vehicle (High Point Circle) and issued the driver a citation
for running a stop sign. After a routine record check it was discovered that the
passenger had an open warrant for violation of probation, and he was arrested
and taken to M.C. jail."

This is one stop where
"No News Is Good News"! Sorry Chief.
It's been so quite we need to report this one!
"Residents gets a summons for an over size sign.
measures it at 15 1/2 " wide by 12" tall. Cuts off the 3" and takes it to
Town Hall & Chief and ask "why me?" and describes
5 signs on his way to Town Hall that are oversized. Namely
"waterfront" realtor (note no caps on "realtor")
and empty lot w/two "no trespassing" signs nailed to trees." Two
strikes on these signs.
Nailing signs to trees in the "Point" is a felony
says Commissioner Bausch. One sign to a lot is strike two. What's next?
A call from the Chief or Tina after this post.
Probably LT. Tina as Chief careful to keep his nice guy rep. Chief says
Town Mgr. says back off on sign issues, says
resident. Not me Chief!

Burglary
Where: North Sewall's Point
residence under construction.
When: Last weekend in April, Sat night the 28th, Sunday @
sunrise.
The Event: Resident has lost about $ 5000.00 from his
new home construction by theives. Recently started sleeping there to
prevent further theft. Sunrise, feint light, awakened by noise. Aluminum ladders that are tied together
are making it! owner scrambles dow from the 3rd floor widows watch,
almost prophetic! A couple of guys in his yard, one in a van and they

leader an Asian starts screaming at the 4 Hispanics with him and the
resident. Resident doesn't understand what he is saying. the
Asian leader reaches into his pocket and almost loses his life as
resident takes aim and the Asian draws shiny cell phone, doesn't raise
it, keeps it low and flicks it open and takes the residents picture! I
guess going to send it to Far East relatives while he is trying to
hold his guts in as he is falling to the ground! Anyway he starts
screaming at the other 4 and they pile into pick up and van and have
to back up to get away as resident "D" is standing in front of van and
won't move. Kinda like Tiananmen Square Chinese kid who got ran over
with a tank Van takes off, only this time the kid is driving.
Resident "D" thinks twice about killing someone over a bag of cement! Lets
them drive off. 30 seconds later SPT officer Scott Donlon goes
"screaming" North on North SPT RD. and catches the banditos & Jackie
Chan! Chan says "we no do anything, we not there", resident tells Cop
check his cell phone my picture is on it, checks, it is!
The Rest of The Story is
upsetting. Officer tells "D" he'll have to press charges "I don't have
anything to hold them on"? "D" decides he doesn't want to spend
the day or days in court. Doesn't press. Short of it is the crooks
don't have the goods, they did do a "felony trespass" but get off. All
of the aforementioned from direct interview of resident "DP". The
thief trespasser has the
residents photo on his cell phone camera holding a gun on him! Holy
Mackerel! We advise
resident to get a Police Report.

Sewall’s Point Town Manager Robert
Kellogg announced today the appointment of Eric Cerniglia as Sewall’s
Point Police Chief. Cerniglia was chosen from over eighty candidates
that applied for the position through a national search. Kellogg
commented that Cerniglia was on his short list from the beginning. “His
resume and personal information caught my attention immediately,” said
Kellogg. Cerniglia replaces Larry McCarty, who retired October 1,
2006. Cerniglia will begin work in Sewall’s Point on January 15, 2007
at an annual salary of $80,000. Mayor Dan Morris stated, “I was impress
with Cerniglia’s thoughtfulness during our conversation and I believe he
has the personal characteristics, professional experience and
administrative talent we need to move the department forward.”
Cerniglia worked with the Miramar Police
Department from 1971 until 2003, when he retired as a Major with the
department. He graduated from Nova University with a Bachelor of
Science Degree in 1977 and Biscayne College in 1980 with a Master of
Science Degree. In accepting the position, Cerniglia said he is excited
about the opportunity and is looking forward to building a strong
community and an oriented police force in Sewall’s Point. For further

I agree that Sewall's Point's adolescence would now appear to have
persisted for too long. I would argue, however, that the past few years
have had the Point living through a second toddler stage, where temper
tantrums, impatience and inappropriate emotional outbursts are the norm.
A complete reading of the depositions in the now-settled sexual
harassment case, the ones available to date, tell a story that is much
bigger than Police Chief Larry McCarty's lapses of good judgment and
questions about his management style. It is a tale of a town staff run
amok. It is a story of personal fiefdoms, special treatment for favored
residents, in-fighting, backstabbing, and sordid behavior that forms the
basis for those who seek the chief's immediate removal, in one form or
another, by nearly all former and current town staff.
This is where The Post editorial's reference to adolescence is
on point ("Let Chief McCarty go," July 1); town hall resembles a high
school class with a substitute teacher. One thing is clear, what has
been missing from town hall for decades is adult supervision. Our plan
to hire our first full-time town manager will provide such supervision.
To the facts. It is true that the chief's behavior requires action,
and the commission was clear. The town will accept the chief's
resignation as soon as the new town manager crafts a well-thought,
methodical succession plan. This is essential to preserve the morale of
the department and to ensure continuity. It was made clear that this was
likely to take place in the next eight to 10 weeks.
Sewall's Point is an incredibly safe place to live. No decision
regarding the chief would be a good one if it puts the town's safety at
any risk. It is precisely why a more deliberate approach is needed. The
chief has admitted to viewing off-color and inappropriate content on his
office computer. None of it illegal. The balance of the allegations
against the chief are just that, allegations.
There have been assertions by those who seek the chief's immediate
removal that he is, in some way a danger; I find this to be outrageous.
If every person who has ever viewed an off-color or even pornographic
e-mail was dangerous and unemployable, work would stop in America. Is it
good judgment to be viewing them on a town computer? Of course not.
Would a good manager be sharing them with subordinates? Of course not.
But do those actions make the chief a danger? I think hardly.
Many who seek the chief's immediate ouster have been demanding the
same for some time, but for other reasons; they are unhappy with past
enforcement of ordinances. The key to resolving their grievances is not
to "shoot the messenger," which is precisely what happened to the former
building official. The solution is to finally simplify the town's
ordinances to make Sewall's Point an easier, friendlier place to live.
The town commission is addressing that problem.
The fact is that The Post's suggestion to immediately remove
the chief and replace him with the next in command would not settle this
issue. Those who seek the chief's immediate ouster also seek the ouster
of his next in command, a person against whom there are no allegations
of any sordid conduct.
All of this seems to be part of a post-election push by a vocal few
to gut town hall impulsively, without any plan, to satisfy either
personal vendettas or to settle political scores. This has left the town
in a difficult position. It is time for the "unaffiliated" of the town
to act in a clinical, methodical, unemotional way, to address the
important issues. The lesson of the depositions is that we need to
completely restructure town hall and bring in competent, professional
management. I expect the recruitment process now under way will provide
us with just such a manager.
Adolescent and toddler behavior is impulsive, impatient and
emotional. Adult behavior is deliberate, non-reactive and patient.
The Post is correct: If we intend to make Sewall's Point a better
place, decisions in this town need to be made in an adultlike fashion

SEWALL'S POINT — Crime in this small, wealthy town rarely diverts
from the occasional loud party or loose dog - little that would draw the
interest of producers of the crime reality show C.O.P.S.
But potential police chiefs - now, that's another story.
By Friday, 81 people had applied for the town's job, vacant since
Larry McCarty stepped down this month after 22 years in the police
department.
The deadline to apply was midnight Monday.
"It has to be a pretty special place to draw more than 80
applicants," said Colin Baenziger, the consultant managing the search.
Though Baenziger never has helped find a police chief, his searches
for town managers and city attorneys rarely draw more than 50
applications.
Baenziger guessed that the town's small police force - there are only
about 10 officers - may be a draw for career lieutenants or captains
looking to move up but in a smaller department.
Town Manager Robert Kellogg said the applicants are a mix of Florida
and out-of-state residents, but he didn't know how many were from the
Treasure Coast. Baenziger said he doesn't plan to look at the résumés
until today.
Kellogg, who started his job last month and will be the one hiring
the new chief, said he wants someone who has "good customer service" and
can reduce the high turnover rate of town police officers, which Kellogg
estimates has been about 50 percent in the past two years.
"One of the big concerns here is that people are leaving," Kellogg
said. "We want to try to find somebody that's going to stabilize that
situation and get staffing up to standard."
The town manager plans to winnow the pool down to about 20
candidates, running background checks on as many as 12 and interviewing
about six. Kellogg said he expects to have a new police chief on board
by the first of the year.
The new chief will be stepping into a role recently dogged by
controversy. McCarty became a lightning rod in the town after he was
sued for sexual harassment.
The case was settled, and the police chief denied the allegations,
which were brought by a former clerk in his department. But several
residents and a town commissioner called for McCarty's resignation in
June when they read depositions for the case, in which McCarty admitted
to having scenes of nudity on his computer.
McCarty, 67, said the lawsuit didn't prompt him to resign.
Rather, he said he was simply ready for something new after more than
two decades in law enforcement.
Kellogg has not specified a salary range for the new police chief.
When he retired, McCarty was making $70,525 a year.

Mayor Chicky referred to a notice from the town manager that Chief
McCarty is gong to retire in June. The Vice Mayor said he was
surprised and wondered who picked that date.
Mr. Williams said Chief McCarty picked the date and "volunteered it
of his own free will" during a discussion about other matters.
Vice Mayor Chicky said he had been told the date was January 2007.
Mayor Baron said it was his recollection that Chief McCarty wanted
to retire in January 2006 but "I asked him to stay on for six more
months so we could get through these other issues with the new
manager."
Chief McCarty stated "my understanding was that I would stay for a
year and I asked for an extension on the insurance." He added that "I
did not say June, I believe I was asked if June was OK and I said OK."
Chief McCarty said he would prefer January 2007 but would do whatever
the Commission wishes "and if someone wants me to leave earlier just
tell me.".
In response to a question from Commissioner Bausch, Chief McCarty
said the Town paid his predecessor's health insurance premiums for one
year and that he would like "a year extension on that for my daughter
and my wife."
Vice Mayor Chicky said he would like to see the Police Chief stay
on until next January.
Commission Morris suggested that each Commissioner discuss this
with Chief McCarty privately during the next two weeks.
Commissioner Morris left the meeting at 9:04 PM.

Publication of depositions has him down so it is rumored. The writer,
the recipient of the depositions by e mail, forwarded them to all the
Commissioners. It turns out none of them had seen the depo's prior to
the Mayors "100% standby by the Chief" statement to the press. The Mayor
had not read them either, nor the Town Attorney prior to his statement
in the press about assuming guilt. To date only Commissioner Osteen has
stepped up to the plate and publicly said ,"not me, after reading
the statement he was shocked and dismayed by the behavior of the Chief
as per the depositions", or words to that effect. Depositions are not
"hearsay" by the way.
Commissioner Busha tells ex-mayor SQ she didn't get Depo's as she
changed her e mail address. Funny cause her address new address was
noted when her old e mail address, addressed. We sent them to new
address and no "rejection" notice appeared. Hhhhhmmmmnnn? Will re-send
to her because we are sure she would not want her name associated with
the " 100% support the Chief" remark after reading dep's. if
she doesn't understand the outrage of the Towns lady folk, then perhaps

She should be supporting her constituents not the behavior of staff in

Good Morning Pointers, greetings from three mile island, otherwise known

that is until I read the unfortunate article in the PB post yesterday. I
am both appalled and saddened by the series of events and lack of
consequences that has befallen this town. Let me be perfectly clear, I
MOST DEFINITELY AM NOT SUPPORTING THE CHIEF, like our Mayor stated in the
PB
Post. Mr. Mayor, I do not appreciate my position as commissioner being
used in your comments. I am in full support of removing the chief from his
position, he is most certainly a liability to this town at this point, and
keeping his as an employee will only cultivate the arrogance that persists
in town hall.
I can assure you that if the chief were my employee and this behavior
occurred, he would have been fired immediately. This can also be said for
any other town in this state. Do you think any other town would keep an
individual as an employee that exhibited this type of behavior? I'm
guessing no. With this being said, I want the remainder of the police
department to know that they have my full support and understanding that
working under these circumstances must be very difficult. The residents of this town must
communicate their outrage that the chief's behavior is actually being
condoned by the remainder of the commission, this is disgusting and this
town's reputation continues to be drug through the mud, I can assure you,
i will do everything in my power to be the voice of the majority of people

In 1984, I came to work for the
Sewall's Point Police Department because I enjoyed the style of
policing the Department provided to the community. I had observed that
in other communities, officers went from call to call, never having
the opportunity to take the time to truly help the people they had
been called upon to serve. In Sewall's Point, the Police
Department has always prided itself in taking the time to provide the
highest level
of service possible to the citizens. This is the police work I have
always felt I was called upon to perform.
To that effect, I have been a loyal and dedicated employee of the Town
of Sewall's Point for 22 years, and for the first nineteen years, I
sincerely felt the Town supported the Police Department and me as a
whole. However, in the past few years, there has been a slow erosion
in attitude amongst a group of dissidents, as well as some other town
employees that is effecting my morale and interfering in my ability to
lead the Department.
As you are aware, a dissident website
allows for the anonymous posting of slanderous comments about me and
the officers of the Department. While I understand that the Town
Commission has no ability to eliminate what I believe to be a
malicious site, the Town should address the fact that a town
commissioner uses this site as a venue to post comments regarding
actions he intends to take impacting town employee's working
conditions. I cite as an example, Commissioner Don Osteen explaining
how he intends to interfere with the operation of the town government
by threatening to monitor all of our phone calls, email, sitting in on
meetings, etc, as a recent example of these actions. While his
threatened activities have not come to fruition, these types of
comments by a town official represents what I believe to be a
pervasive undercurrent of hostility towards me and other police
department employees amongst some individuals. I have also had
conversations with Commissioner Osteen when he has directly referred
to at least one of the officers in the Department using derogatory
names. This seriously affects the morale of the officers.
The Town Clerk, Joan Barrow, who makes
disparaging comments about the officers and me, such as referring to
the officers as ''the babies," and me as a "pig", also shows this
behavior.
